GENERAL TERMS AND CONDITIONS OF SALE AND DATA PRIVACY POLICY
PART 1: GENERAL TERMS AND CONDITIONS OF SALE
1. PURPOSE
These general terms and conditions of sale aim to define the rights and obligations of Piecesanspermis and the Client regarding the products presented on its website www.piecesanspermis.fr (hereinafter referred to as "the Site"). They apply exclusively between the company owning the Piecesanspermis.fr site, a SARL with a capital of €1,000,000 registered under the unique number 510 189 376 RCS of Roubaix-Tourcoing, whose registered office is located at 242 rue de l'Yser, 59200 Tourcoing, France (hereinafter referred to as "PSP"), and any individual consumer visiting or making a purchase via the Site (hereinafter referred to as "the Client").
The PSP website allows the Client to order products available on the Site online (hereinafter "the Product(s)"), in accordance with these general terms and conditions. Any order placed with PSP implies the Client's unconditional acceptance of these terms.
2. PRODUCTS AND COMPLIANCE
In accordance with European Regulation 1400/2002, the parts sold by the company (unless otherwise stated in the product description indicating "original") are replacement parts of EQUIVALENT QUALITY, also approved for maintenance and repair. They correspond to the quality of the components used in the vehicle's assembly but are not manufactured according to the specifications and manufacturing standards provided by the car manufacturer. In other words, these parts are of the same or even superior quality but may, for example, be made from a different material or be a different color. These parts are referred to on the site as "adaptable parts."
The products for sale are presented on the PSP site with a technical description detailing, in part or in full, the characteristics of the product.
3. CLIENT OBLIGATIONS
3.1. The Client agrees to provide PSP with real and necessary information for fulfilling the services under these conditions as requested online, particularly their full name, address, phone number, and valid email address. The Client is responsible for any consequences resulting from false, inaccurate, or unlawfully obtained information. The Client can modify their data in the "My Account" section.
The Client agrees to have their parts installed by a certified automotive professional. If a part is found to be non-compliant, PSP will not be held responsible if the Client did not have it installed by a professional. The professional must verify the part's conformity and suitability before returning it to the Client. If an anomaly is detected by the professional, the defective part will be replaced free of charge by PSP.
PSP and its parent company ASPL shall not be held responsible for any defect or non-compliance of a part if it was not installed by a qualified automotive professional.
4. ORDER
4.1. Any order will only be validated upon payment acceptance.
4.2. PSP reserves the right to cancel or refuse an order in case of a dispute with the Client regarding a previous order.
4.3. PSP can accept orders based on stock availability. It informs the Client of product availability on the Site at the time of order confirmation. If, despite PSP's vigilance, the products become unavailable, PSP will notify the Client by email as soon as possible. The Client may then cancel their order and receive a refund of any amounts paid. The permanent or temporary unavailability of a product does not engage PSP’s liability nor entitle the Client to compensation.
4.4. Once the order is placed, PSP sends an email confirmation to the Client and notifies them when the products are shipped.
5. PRICES
5.1. Prices displayed on the Site are in euros, including all applicable French taxes (French VAT and other applicable taxes), excluding shipping costs.
5.2. Shipping costs will be indicated on the product page and in the Client’s cart before final order validation.
5.3. Prices may change at any time without prior notice, particularly due to changes in fiscal or economic conditions. Items will be billed at the rate in effect at the time of order registration.
5.4. The shipping costs indicated on the product page are for informational purposes and may be subject to modification during order validation.
6. DELIVERY
6.1. PSP delivers its products to Metropolitan France, including Corsica, and Europe.
6.2. Delivery cannot be made to hotels or P.O. boxes. The delivery times indicated on the Site are estimates corresponding to average processing and shipping times. To ensure timely delivery, the Client must provide accurate and complete address information (such as street number, building number, access codes, intercom name/number, etc.).
6.3. If delivery is delayed by more than 30 business days and the product has not been shipped, the Client may cancel the order via registered mail with acknowledgment of receipt and request a refund at the following address:
Piecesanspermis – Service Commande – 242 rue de l'Yser – 59200 Tourcoing - France.
If the item is shipped before the cancellation request is received, PSP will refund the item and shipping costs upon receiving the returned product in its original condition with all tags attached. PSP will inform the Client about the order status. PSP is not responsible for delays beyond its control.
6.4. Upon receiving the order, the Client must check the product’s condition and notify the carrier and PSP of any issues within 2 days.
7. PAYMENT
Full payment is required at the time of ordering. At no time shall the amounts paid be considered as deposits or down payments. Clients can pay by credit card (Visa, Eurocard/Mastercard) or bank transfer.
Credit Card Payments: The Client must enter their card number, expiration date, and security code. Entering these details authorizes PSP to debit the Client’s account. Transactions are secured by CIC bank.
Bank Transfer Payments: After selecting this option, the Client will receive an email with PSP’s bank details. The order will be processed upon receipt of payment.
8. EXCHANGES AND RETURNS
RIGHT OF WITHDRAWAL
