The French Conseil d'Etat has ruled that roadworthiness tests for two-wheelers should come into force by October 1, 2022. This should also apply to unlicensed cars.
The introduction of roadworthiness tests for two-wheelers is a long story. The State favored a series of compensatory road safety measures to avoid the wrath of motorcyclists under a decree scheduled for release in August 2021, cancelled at the request of Emmanuel Macron. But the Conseil d'Etat has just ruled that it must be implemented by October 1, 2022.
This may also concern motorists, as the first decree also applies to four-engine vehicles. This includes so-called four-wheelers without a license. This also applies to vehicles such as Aixam or Ligieror the Citroën Ami.
The timetable for the introduction of roadworthiness tests for motorcycles has been called into question by certain associations, who have referred the matter to the Conseil d'État, given that the original date of January 1, 2023 was too late.
In a press release, he wrote: "The interim relief judge notes that European law has required this inspection since January 1, 2022, and that the government has neither waived any technical inspection nor implemented and declared any safety measures to the contrary." Under European law, this could justify waiving it, as it is limited to projects that declare such measures, which have more or less direct effects.
Furthermore, "the judge deemed it unreasonable to postpone the date of entry into force for the oldest vehicles beyond October 1, 2022, given the time required for the substantial implementation of technical inspections. For these reasons, it today suspends the government's decision schedule".
The Council takes decisions in favor of the Association's application of the law. It stressed that the decree had not been amended, "and therefore remains the definitive state of the law before the court judges". The government had made it clear to Europe that it intended to rely on compensatory measures, but "the interim relief judge stressed that neither the written instructions nor the communications at the hearing could specify the content of the measures envisaged". In any case, whatever the content of the measures notified, none of them is being implemented".
